The Appeal Court sitting in Abuja has declared as unlawful the rendition of the detained leader of the Indigenous Peoples of Biafra, Nnamdi Kanu from Kenya to Nigeria.
A three-man panel of the appellate court led by justice Hannatu Sanke in a judgement held that the arrest of the separatist agitator was against the international treaties and conventions.
The panel also held that there was a serious violation of Kanu’s rights by the federal government in the manner he was arrested and brought back to Nigeria without following extant laws on extradition
Justice Sanke led panel agreed with Kanu’s counsel, Mike Ozekhome that the Federal High Court where the federal government filed the terrorism charges lacked jurisdiction to hear the case.
The appellate court strongly expressed the view that the judiciary must not shy away from calling the executive arm of government to order if it goes against the law.
