Breaking: Governor Oyetola Regains Mandate As Court Of Appeal Quashes Tribunal Judgement

The Court of Appeal sitting in Abuja has set aside the judgement of the Osun State Governorship Election Tribunal, which nullified the victory of Governor Gboyega Oyetola in favour of Nurudeen Adeleke of the Peoples Democratic Party. Delivering the judgement, chairman of the 5 man panel of judges, Jummai Sankey set aside the entire proceedings of the lower tribunal over what she termed ‘faulty composition’. This was based on the argument ,that majority of the lower tribunal’s judgement was prepared by Justice Peter Obiora, a member its three-man panel, who did not participate fully in the tribunal’s proceeding. In her ruling, she stated that ordinarily, the matter should be returned to the lower tribunal for retrial, but the stipulated period of 180 days for appeal had long elapsed. However, the five-man panel of the appellate court, delivered a four to one split judgement in favour of Governor Oyetola
