The Appeal Court sitting in Abuja has set aside the judgment of Osun state governorship election petition tribunal that sacked Senator Ademola Adeleke as governor of the state.
A three-member panel led by Justice Mohammed Shuaibu unanimously held that the tribunal reached conclusion on over voting without taking into consideration on the voters register from the polling units.
The election petition tribunal had ruled in favour of a the former governor of the state Gboyega Oyetola that Adeleke was not dully elected in line with the electoral law
While delivering the judgement, two out of the three-member panel of the tribunal held that Oyetola proved that there was over-voting in some of the polling units.
